Nevada Proposed HAI Rule Changes

July 23, 2010

The state of Nevada has issued a notice of public hearing regarding the intent to adopt regulations in support of its HAI program.

Nevada’s healthcare-associated infection (HAI) reporting and disclosure statute was enacted in 2005 as an amendment to an existing 2002 Nevada Sentinel Events Registry statute, Nevada Revised Statutes. sections 439.800 to 429.890. The statute requires mandatory reporting of HAI data.

On July 12, 2010, the Nevada State Board of Health issued proposed regulations that will serve to amend chapter 439 of the Nevada Administrative Code.  The proposed regulations will add National Healthcare Safety Network (NHSN) reporting requirements.  Additionally, the proposed regulations will address the following items pertaining to reporting:

  • Enrollment and training requirements;
  • confidentiality of data, including what can be publicly reported;
  • collection and reporting of data; and
  • data accuracy and retention.

The Nevada Bureau of Healthcare Quality and Compliance has requested comments from hospitals, ambulatory surgery centers, and emergency medical care centers.

A public hearing will be held in conjunction with the State Board of Health meeting on August 13, 2010.  The hearing is scheduled to begin at 9 a.m.
